HELP! New L/C IS350 owner, old IS350 problems
hi guys, really hope i'm not in the wrong forum asking the wrong idiot questions. In a potential bind, and as part of the new Lexus fanclub I'm hoping my wiser peers can help me through this.
SHORT VERSION:
My 'new' 2015 IS350 F Sport has potential damage my Cali dealership didn't disclose, not sure on course of action.
LONG VERSION:
So my wife took off this morning in the 350 we closed on at 11pm last night. Lexus Certified, clean Carfax (with no mentioned service records from original owner, which i'll get to), car is spotless, sales guy a little too excited for his own good but, y'know, sales guys. I text her this afternoon asking how the drive was. She says good but thought she noticed vibrating on the drivers side when she was turning.
Being an OCD-records kind of guy I call Service at the Cali dealership and ask for anything related to the car, as our sales guy recommended to do the night before as he didn't have access to them. Now keep in mind i specifically asked for the records during the negotiations and he said the Carfax didn't list the servicing likely because the ASC guys probably forgot to, or any other myriad of things. They fire over a solid but incomplete listing of servicing – ie 5600, 11500, 26000, traded in at 34500 – and one big thing pops out. The first owner had run a curb on the left side, somewhere before 26K. Brought it in Feb 25 and Mar 07 of 2017, at which point the Service dept "RECOMMEND REPLACE LEFT FRONT WHEEL HUB/BEARING ASSEMBLY AND PERFORM WHEEL ALIGNMENT. GUEST DEFERRED REPAIR AT THIS TIME. NO CORRECTIONS MADE."
So I read this, and call the dealership Service dept and ask, 'if the service dept noted and recommended replacing the hub/bearing assembly, why is it not noted as having been repaired on the certified repairs list after the original owner handed it over?'. I was told that it hadn't been repaired and likely went away all by itself, which is why it wasn't noted. I tell them that's clearly not the case as we've had the car for less than 12 hours and my wife had already noted the vibrations without even knowing about the curb incident. My blood pressure is a bit high.
QUESTION: Do I have any legal recourse in California regarding dealer accident disclosure? I'm pretty sure the L/C program won't cover the repair (could be wrong, but based on how the Service team dodged my questions on the call it's what I suspect) and it's definitely not cheap. Pretty livid as well that our sales rep could have pulled the records, and clearly this is why. I'd rather sort this out with the dealer, but I'm preparing for worst case scenario on the 'as-is' alibi.
