Sounds like the other party's insurance isn't being very cooperative with you. Is it possible to get your insurance to cover getting it fixed with OEM parts, then they go after the other party's insurance for compensation? I know that you can do this in some places, but I'm not sure about Ohio.

in hindsight, you should have went through your insurance company in the first place. they will do what they can to keep you as a customer (hopefully). this includes roughing up the offender's insurance to cough up more money.

for the situation you're in now... man you might be baked. you should still try to go through your own insurance and have them fight the other insurance company for you.
