Why would you except to get a free fix when you are out of warranty?

I am going through an appeal w Lexus as my IS250 is using about 3/4 of a qt. of Mobile 1 synthetic oil every 1200 miles. My engine re-build was denied yesterday after our local Lexus dealer called Lexus corporate & I am appealing it. The vehicle was a Lexus certified vehicle & now has 80k miles & has been meticulously maintained. I'm curious if others have had a similar situation with this year car and what their outcome was. I don't want to risk running out of oil & having the engine seize.
