Here's what happened. I was leaving my girlfriend's house around 10:00 last night. I was going southbound on Capitol Exp. in San Jose. I stopped at a red light. Im about half a cars length behind him. Then the car in front me starts reversing. I see his reverse lights so I start honking. Then he backs up into me. I'm boxed in so I can't go anywhere. I get out and he said that I was driving to fast and why did I hit him. I called the police to get a police report. The officer said it was his word against mine. Any advice would be appreciated.
File a police report, and take pictures of where the accident happened. Make sure you take a picture of the actual road to prove there were no tire marks left by your car.
If you were driving fast enough to have to slam the brakes before hitting someone -ABS or not, there should be some tire marks. Thus, proving you did not hit him.

go back to the road and take pics and all that, would be sick if u had one of those things that moniters ur speed and stuff and saves it, then u could prove u werent speeding, or a dashcam or something, lol
Investigators can determine what lights are on when they go out after accident. Call your insurance. Have them start an investigation. NOW. At the least, they can test your black box and determine your speed. A "0" reading would be a major problem for the other guy.
what retarded people can do.... i wonder... just that desperate to get extra insurance payouts? or did he wreck his bumper which had no money to repair... sorry for the loss though.... might wanna get investigations going on right away

If the data can't be retrieved from your car, see what your lawyer says about getting the data from his car's.
