Got a speeding ticket, how to do "Trial by Written Declaration" ??

Default Got a speeding ticket, how to do "Trial by Written Declaration" ??

got a speeding ticket last week, went 49 in 35 speed limit. And thinking to do "Trial by Written Declaration". Anyone ever did that ? How is it going to work if somehow I did speed 49 ? seems like trial by written only if you have a "proof" you didn't speeding, is that right ?

LOL....it was one of those street where there are 3 zone, 40 mph then 35 mph because school nearby then go back to 40 mph again. I knew there was always cops around that area but i just completely forgot that morning

fyi...if u lose the trial by declaration, u still have the option to appear in court and contest the ticket.

And, you will most likely lose the trial by dec.

You have a much better chance in court before the judge making some good arguments, and there are MANY technical defenses to the citation.

P.S. I am an Esq. and I have handled numerous traffic citations. I can help (for free) if you want.

Got a speeding ticket in January and was convicted with TBD (as bad is it sounds - it is a necessary step). Later got it dismissed beginning of october after I appeared in court. Cop got me going like 93 in a 75 max freeway.

Good to know! But i thought contest the ticket in court is most likely gonna lose.

So did u have lawyer with u as well? How did u defense urself? Sorry this is my first ever speeding ticket, its not even really speeding

No lawyer I did just how it says in that link. The point is to delay as much as you can. Call the court and get an extension. (The longer it goes the higher the chance of winning).

1. mail in letter from court
2. call to ask for extension for payment (i got 60 days others get 30)
3. send the payment with TBD after extension (i say mail it 10 days before due)
4. they mail you stuff to fill out the TBD wait about ten before deadline to mail after you're done.
5. You are not going to win the TBD (unless you have stuff to prove - which I didnt) I just wrote "Not Guilty. I have great respect for the court and police department." The point is that the cop does not mail his side of the TBD and you win automatically. (If he does you will probably lose)
6. Come back and revive this thread if it gets here lol..

What does the delay do for you? You mean you are just praying that the cop doesn't write a declaration, and you think giving him more time is the right way to do it? That is the same defense of "set it for trial and hope the officer doesn't show" That doesn't sound very smart, and I have sat in enough court rooms to know that 90 percent of them show. Expecially the ones that give out lots of tickets.

To each his own, I guess.
