are you 100% certain that there is no surveillance in the parking lot? I don't really see a hate crime here unless you could prove that whoever did this to you did it because they know or perceive you as a member of some group which would be strange. Have you asked for a copy of your recorded statement with the insurance company? I think its worth consulting with a lawyer, but I too don't see enough damage in the photos to make this worth fighting for for both the lawyer and you. Have you fixed the paint on the car already? Most of the stuff like others said appears to be some filled chips and a bumper crease maybe that is why insurance is thinking it is previous damage. Just curious How did they manage to pry open the door? I don't see a ton of damage to the door showing forced entry. just surface scratches? Any interior damage photos?

One bit of advice to any and all, whenever (always) your statement is recorded. Only offer fact, do not lie, tell the truth, but do not offer any information whatsoever outside of what is needed. Subjective comments, contain them. What we often forget, because it's human, is that any entity, legal or otherwise, on our insurance co's side, is not on our side. They are on the side of the shareholders, the board, and the executives. I suppose this thread is yet another example. I am not friends with my insurance agent, nor anyone in Northbrook, IL. I pay them every 6 mos. for a service. So far, between auto and home, that's about 17 semi-annual payments, and not one red cent coming back less a $100 Target gift card. This is what they like, and how they want to keep it. Anything recorded, they will review over and over until they can find something to dispose of the claim.

Long story short I am looking for an insurance attorney who will assist me in suing the ever living hell out if allstate, because I have had it, and do not want to deal with this it has been going on since june of 2017. Any tips or anything would be appreciated thank you.
You are in NY--call Michael Cohen. This sounds right up his alley. @MichaelCohen212

State troopers have jurisdiction for vandalism that occurs in a parking lot on private property???

Wouldn't he only be the 4th client? Too small, lacks experience imho. Arnold Proskin, but no longer needed, fraud claims were dropped.

I had a claim denied by GEICO (their claimant backed into my car and admitted fault) I filed a complaint with State Insurance Commissioner and GEICO ended up paying claim.
i spent 40 years in the Insurance Industry and denying claims is fairly common.

Agree with the person who explained HIPPA. In my profession I dealt with this almost daily. There was NO HIPPA violation.

nit pick: It's HIPAA, you guys.

As far back as I can find photos of this car, I am seeing damage on the rear bumper where it looks like someone backed into the car. I'd love to see the vandalism of the word "kike" in there though, I feel like that would definitely mean something to insurance/the lawyer, since it is clearly vandalism.

Right now this is the least of my worries, I appreciate the feedback and opinions you guys have given but this is minuscule compared to what's on my plate now, thank you again for your advice and opinions.
