Salesperson probably put it up there thinking he would score. The dealer was probably not behind him on this and now HE is on the hook.

However nice to know that you can go to Nebraska and get a M3.....also nice to see that color in more detail. I thought it was Carbon Black.

Either way, they are gone from Ebay if they don't honor this I believe.

Thats amazing, should be interesting to see how this unfolds, dealers are pros at passing the problem around to others until the customer gives up

Brilliant. Instead of taking a several-thousand dollar hit on one particular car, they're now probably going to lose hundreds of thousands in sales due to bad publicity.

The buyer won't sue, and the dealer won't give in, and will just deal with whatever sanctions eBay puts on them--they don't care. Buyer should take it to the local news media, see if they'll do a story on the 11:00 news.

This thing is spreading pretty quick, this morning when i checked it out it had 4 pages i believe, but Autoblog posted the story and now its like 20 pages... Dealership should just bite the bullet

think about how much trouble that dealership would be if they sold that car and he took them to court saying they not only didn't honor their deal but sold the car he won via ebay which is a legit contract binding both of them to the deal. They'll only get away with doing this if the bidder decides to not make them go through with everything, if not they're gonna have to make him happy.

Yeah--how many of those bloggers are in the dealer's sales radius? Until the story hits the Omaha news, there's really little downside to the dealer.

i guess the dealer didn't read the part about the winner and seller being in a legal contract to finish the transaction.

Default Ebay will score big........

The winner of all of this will be eBay (not that they need the publicity) but if they do the right thing and help this guy this will have alot to say about them enforcing their own rules and setting the example...........

This thing is now world wide and people are posting from all over the world.... if anything BMW USA should step in and score big forcing their dealer to sell it at auction price........

I checked the dealers eBay feedback and they have a negative from another buyer who got screwed by them....hummmmm..........
