Alright @BayeauxLex I'm no authority here, I would say it's ultimately the other drivers fault (and that's what I would argue to the insurance company), but you should never try and speed past someone immediately after they change lanes, because people are unpredictable, as proven by that video. And I've driven enough in places like LA and Texas to know that first hand
I would likely say the challenger as he merged in an intersection, that's exactly why you aren't supposed to do that/as usual a positioning error caused a crash. It's also why there is a no U turn sign there......
Secondarily I would say that whoever was driving the capture car was not in the correct lane and was not paying any attention, I had a worse situation two years ago and I was still able to bleed speed and dodge. Mostly because I always assume people are idiots and will do their best to crash into me lol!

I agree with geko....50/50 on the fault here. An improper-turn like that on the part of the Challenger is clearly a violation, but so is, in most cases (including this one), if you hit someone from behind.

Plenty of cars designed to protect pedestrians that are not blobby. Most of them.
