I would issue tickets to both. Improper lane usage and failure to reduce speed to avoid an accident, respectively.

Alright @BayeauxLex I'm no authority here, I would say it's ultimately the other drivers fault (and that's what I would argue to the insurance company), but you should never try and speed past someone immediately after they change lanes, because people are unpredictable, as proven by that video. And I've driven enough in places like LA and Texas to know that first hand

I would likely say the challenger as he merged in an intersection, that's exactly why you aren't supposed to do that/as usual a positioning error caused a crash. It's also why there is a no U turn sign there......

Secondarily I would say that whoever was driving the capture car was not in the correct lane and was not paying any attention, I had a worse situation two years ago and I was still able to bleed speed and dodge. Mostly because I always assume people are idiots and will do their best to crash into me lol!

I assume the same and it serves me well. Even in simple situations like a person is two lanes to the left and is trying to merge right. They are never just one lane away from where they need to be. It’s at least two lanes and often more. I assume they are going to come all the way over and will never look to see a car two lanes over. I speed up and get out of danger.

It’s pretty hard to justify, not slowing down and avoiding the collision.

I agree with geko....50/50 on the fault here. An improper-turn like that on the part of the Challenger is clearly a violation, but so is, in most cases (including this one), if you hit someone from behind.

Turning car is 100% at fault IMHO. One has to ensure they have the ability to stop in an assured clear distance ahead. The turning car changed lanes without safety.

Vehicles back up...there were specific examples given in this thread.

Even if it was an accident caused by the person running into the fins, whats wrong with making a vehicle less likely to cause injury to somebody?

and yet you don't like blobby cars, but they're all heading that way.
Plenty of cars designed to protect pedestrians that are not blobby. Most of them.

To your point, that is one reason a Cybertruck cant be sold in the EU. Pedestrian Safety
