Does anyone know the law regarding old Liens on vehicles?
 

I'm in a pretty interesting situation.

A relative passed away years ago and one of their vehicles was sitting in the garage for this time.

Obviously the Payments on the car stopped being made years ago and no one has tried to come collect or repossess the car.

The lien is from Calgary but the car is in Quebec , and was registered and driven in Quebec for many years.

I have the opportunity to take possession of this car if I wanted.

What I know so far is that the ministry does not care about vehicle liens, I could get it registered no problem, they will not put up any fuss, but in some cases a repo guy could come knocking on your door looking for the vehicle.

But does the lien in another province still have jurisdiction here?

We are trying to find the details on the creditor and get in touch with them, but so far no luck.

You are in Quebec. The car is in Quebec. Is the lien registered in Quebec or only in Alberta? To be enforced in Quebec, it must be registered in Quebec. Highly unlikely the lien holder would ever do that.

2nd-when does the lien expire?

3rd-this really should have been handled by the executor of the estate.

That is not how liens work in Canada, nor in Quebec.

There is no title in Canada the way there is in the USA.
