i bet the sword was really expensive, i've seen how much they sell for in japan and their prices are almost the cost of a new bike. but in the defender's case, i guess it was a good investment lol

wow thats a pretty crazy story. we need more details if we want to speculate on any potential charges like if the victim was armed or came at the homeowner in any way.
seems to me like a case of imperfect self-defense. defendant probably had the requiste mental state of fear of imminent bodily harm (using the reasonable person standard) but seems to have reacted with unreasonable, inproportional force in his defense. on a public policy basis i doubt the DA will follow through with charges. maybe just a slap on the wrist. people aren't perfect in the heat of the moment.

Too bad someone had to die. I'm sure there was nothing in that kids room that was worth a life.....but you do the crime you do your time....or sometimes worse.

Here in Canada if a thief trips over a carpet and breaks his leg or something, or slips down the icy front steps carrying your 50' plasma TV and hurts his back, he can sue you. Never heard of a case where one did, however; but the option is there for them. It's ridiculous. Not like it would hold up in court or anything, because the defendant could just say that the thief would likely not have tripped over his carpet had he not been trespassing on his property in the first place.
When I was younger one of my neighbors was bitten in the ass by our German shephard whilst retrieving his son's ball which had been in our back yard for about a year and a half at the time. He sued us but lost... the judge ruled that he likely would not have been bitten by the dog had he not trespassed on our property.

This story was all over the local news in my area. I would've done the same thing if he approached me and the only weapon I had was a sword.

Not siding with either the kid or the thief, but if it were me, I would have called the cops first, then waited with a sword by the garage door in case the thief entered my home and tried to attack me. Let's see how this plays out.

Good points. Was he "trained" in swordsmanship? How well was the sword kept? Clearly it was sharper than a ****  Still though, I don't see charges being pressed. Its not like he chopped his head off.

People who's fiance's won't let them have guns... like me. Hahahahaha. I have a katana (just a zinc blade, only tip is sharp). I also have a life-sized Master Sword (think Legend of Zelda), cuz me and the fiance went as Link and Zelda for Halloween one year.
I have serious doubts that either of them would even be in tact after a serious blow, but if there's ever some odd noise somewhere in the house late at night, they're a great confidence booster. I know if I saw an angry man carrying a sword I'd get my ass away from where I was immediately.
Also, funny to see how people from CA respond differently than everyone else. Isn't the law in CA that you have to offer an intruder milk & cookies and wait for them to kill a family member before you can ask them to leave?  Dude should get a big thank you from the local PD.

thats just nuts.. i cant really say the kid was at fault. if the intruder lunged at him and pushed him against the wall, then it sounds like self defense. just sucks someone had to die due to theft. the consequences are just not worth it
