Well the insurance finally called and we discussed that I didn't want aftermarket parts.they said they would agree to a used Lexus door because they cannot get a new one because the car is no longer in production.i really don't care if it is a used part as long as it is not an aftermarket.what does everyone think about this. They offed me a rental but I really don't need it.just want my car back

Contact your own lexus dealership and see if the fender is available. I will just bet you money that it is still available !! The car was basically the same form 2002 to 2005. When you did go see the car how bad was it ?

A used OEM door is way better than fixing/reskinning your door IMO. Also the entire door shell can be repainted so if the repaint is dead on, there will be no evidence it's been replaced. I'd be scouring the internet for the one you want, maybe find the same color if you're lucky.

Couple of things:
First, you are probably not going to get this from your insurance company. Many policies exclude value diminution claims and you agreed to that when you purchased the policy.
Second, if you do not involve your insurance company and instead go directly against he at-fault party, you can get diminution, but it is not going to be easy. When they say "no" and you have to go to court, you can't just whip out some formula. You have to prove the basis for the reduction in value you are claiming, which involves hiring an expert to render an the opinion based on a reasonable degree of certainty.
You are also probably screwed on OEM parts. If you are going under your policy, you probably agreed not only to aftermarket parts, but even used parts, that have the same fit and finish. If you are going against the at-fault party, it would be on you to establish why the specific generic part they want to use is not as good as the used part that was on your car that got damage. Remember, when the crash occurred, it wasn't a new bumper that got hit.
