It will be interesting to see how Lexus handles this, especially when the words in the CPO warranty are clear and SHOULD BE UNDERSTOOD IN USUAL SENSE. It just amazes me to no end that they now believe "unpublished" words are included in the warranty contract. How could anyone enter into a contract without seeing, let alone reading, unpublished language? For it is the words of a contract are to be understood in their ordinary and popular sense. Not some alledged unpublished information that could alter it meaning or intent. Yet it sounds as if LEXUS has some mystical language included but not shared with those who purchase their CPO warranties.
I predict this thread will generate a lot of interest depending on how the OP's claim is handled.

...man this is really mind blowing !!! I own a 2009 malibu also & we had an issue, just 3 months ago,in which the car loss total power. It went to the dealership & they couldn't figure it out after 3 days. The dealership called corporate(I'm assuming) , but someone from G.M called & informed me that the motor would be replaced free of charge. They gave me a Chevy Volt to drive & a week later, I had a new engine. I was told that replacing an engine would be much cheaper than replacing a loyal customer...go figure !!! I would expect the same from Lexus or at least, something close to comparison, since there was no neglect on your part
