Totaled or not?

I sent my car to the best car shop, in this case a shop that repairs Ferrari’s, etc. These shops are approved shops by most insurance companies and nothing will stop them from getting it fixed at the best shop. The shop I used was very meticulous and used Lexus parts. Good luck to you. Repairs are also warranted for life of the car. Good luck to you.

Thanks for all your kind words, the damages exceeded the value of the vehicle by ~$500, and per DC law you can't repair the vehicle once damages exceed a certain percentage of the value. Currently unsure of what's next on the roadmap, I am most likely going to go with a post-facelift SC430.

Make sure to go after dminished value. If it was your own fault and your own insurance, you can't get diminished value, but you can if it's the other guys insurance.

I'd never buy your car from you knowing what happened regardless of how well it was repaired unless I was getting it for way less than market value. That's the way every other potential buyer will approach it too and you have to disclose the accident even if it doesn't make it on to Carfax.

Being that it's already decided that it will be totaled diminished value does not apply. There may be room for negotiation after the other drivers insurance company makes a buy out offer. Depending on the company the offer may be fair or low ball.

I had a car totaled in a similar situation. The other driver had Allstate. I hand carried the police report to Allstate showing that the other driver was written up by the police as being at fault. The following day Allstate sent an appraiser to look at the car, declared it was totaled and made a fair offer. I only needed to sign a release that we would not sue due to injuries, and I had a check in my hand that week.

There is no need to sign away your rights for a delayed personal injury claim to receive a property damage settlement. Should be handled as two separate claims.

That's not exactly correct. No law prevents you from having the vehicle repaired. If damage exceeds 75% of value, you will be given a salvage title. D.C. Code § 50–1331.01 (12)(a)
