Default Toyota/Lexus Economic Loss Settlement

I received an email today from the "settlement administrator" for the claim I filed regarding unintended acceleration in Toyota & Lexus vehicles. My allowable loss is $125.

Dear Eligible Toyota Economic Loss Claimant,

Gilardi & Co. LLC (“Gilardi”) is the Court-appointed Class Action Settlement Administrator for the Court-approved settlement in In re: Toyota Motor Corp. Unintended Acceleration Marketing, Sales Practices, and Products Liability Litigation, Case No. 8:10ML2151 JVS (FMOx). Please be advised that all appeals have been resolved in favor of the settlement and in favor of monetary benefits to Class Members that filed valid claims.

As of March 14, 2014, we have commenced mailing Distribution Payments to eligible Class Members in accordance with the Court-approved Settlement Agreement. Please (i) note that the mailings will be conducted on a rolling basis, over a 5-day period and (ii) allow sufficient time thereafter for postal delivery and potential delivery delays out of our control. Please also note that claimants from whom we require further information to process their claim will be notified by postal mail during the same time period.

Once received, please cash your Distribution Payment promptly, as checks will be void as of the 91st day after the issue date listed on the check. You should consult your tax adviser to determine the tax consequences, if any, of this distribution. Please do not contact Toyota, Lexus, and/or Scion dealers or Toyota regarding this distribution as the Court has ordered that all such questions be directed to the Class Action Settlement Administrator.

I would not take that money, Toyota/Lexus never had such issues. I would feel terrible cashing such check,.......to each their own.

To each is own. I had to drive 90 miles to the closest Lexus dealership to get this recall done. That check will barely cover the gas!

Received a check of $125 yesterday and I will take that money without hesitation.
Had to waste my time with recall on my Avalon and my wife's RX350. Apparently Toyota has no problem paying $US 1.2B in fine and Toyota as a whole is ~$US 217B revenue company. I would not feel sorry for Toyota.

This is why i don't like class action law suits, only the LAWYERS get the big bucks.
$125 is a joke, if you think about it.
I'd rather get $500/1,000 OFF on my next Toyota or Lexus purchase.

They say different models in different states received differing amounts. The amount for the 2006 400h was considerably larger. It would make you feel badly. I had traded it in in 2010.

Lawyers
Insurance people

I will gladly spend the money, if some are headed my way. I will spend it on some more stuff my Toyota-Lexus cars will need along the way.

Ouch, I bought a 06 RX400h in March 2010. It shows $1085! I did not file a clam as I think the whole thing is silly and had no idea it would be more than $3. The claim deadline was 7/29/2013.

Over that the year the payment goes up. If I had purchased in June 2010 the payment would have been the max of $2695.

Wow, smassey 321 that has got to hurt! Unfortunately a person had to file a claim by the deadline to receive a settlement. I had no issues and so qualified for the minimum settlement of $125. I think that was to reimburse owners for time and travel to the dealership.

I am glad the lawyers made the big bucks and leave us some pocket change. At least I got a couple of lunches out of it.
Do you all think Toyota will voluntarily pay $US 1.2B out of goodwill?

GM's problems are just beginning and the hammer will fall on them just as hard if not harder due to the number of deaths and injuries. Also, a much larger number of vehicles affected.
