I have lost faith on the OP. He received a letter from the legal department of Lexus after investigating the crash. I requested that he post the letter here and so far after several days he has not done so. My thinking is that the letter states that Lexus finds nothing wrong with the car and that their only conclusion is that it is driver's error. That he put the car in gear and it rolled. And after the accident, he claims he put it in Park. This is from the guy who admitted in this forum that he does not use the emergency parking brake. He completely disregard the standard operation instructions of his car and then he tries to blame Lexus and its workmanship to that accident.

No offense - but does it take a product liability attorney to underscore what driver's responsibilities are when operating a vehicle as per design?
It is high probability this is a case of driver failure - failure to follow operating instructions, that are universal to ANY vehicle.
1. Engage the parking brake when parking.
2. Point wheels to curb when on slope.
3. Dont push your luck when walking away from vehicle on slope, while vehicle is running.

Since he loudly went public on FB and here he probably already knew Lexus' response and wanted to create enough bad press to try to force Lexus to give him a new car to shut up.
Since he freely makes his accusations in public but is reticent to share Lexus' response, I call clown.

Recovering Lexus Addict
Something does not smell right. That level of damage is not caused by a car rolling a few dozen yards down a hill and hitting some bushes and small trees.
Back in the 1980s, I parked my Ford E150 fullsize van on the short, steep driveway I had at the time. It was a winter day and there were patches of snow and ice on the drive. When I looked out after dinner, the van had slid into the middle of the cul de sac. I found it still in park. I wondered how many neighbors drove around it and shook their heads at my stupidity.
BTW, automakers have learned that most drivers never use the parking brake and they test the pawls holding ability and release on very steep inclines at their proving grounds.
