Default Okay to change old ATF?

I believe the tranny pan gasket is leaking, but the fluid inside has not been changed for awhile. It's a brownish red. I had the rear main seal changed, but the mechanic was able to do it without draining the tranny, maybe half a liter came out when removing the lines and such, and he just topped it up with ATF Type 4. But I need to drain and drop the pan, which I think is like 2 liters. Will it harm the tranny when I top it up again with fresh ATF Type 4?

Also, anyway to fix a leaky flare fitting? The fittings that run to the tranny for the hard cooler lines are leaking a little.
