thats good but i need a pic of the lower suspension BEHIND of the rotor (think turning the wheel all the way to one side and taking a pic

Hm, can you take pictures of signs where it says 'private property no trespassing' and that the sign was clearly illuminated at night?
Even if the sign is placed in the right spot, often the reflective paint on it fades over time and they are not reflective any more. That can even be used as a defense in STOP sign cases ("I could not see it, it is not reflective"). Sun does a lot of damage to best of paints, as we all know.
ANd then - was the security guard following proper procedure? Find out what the law says about proper procedure in such cases - is it proper to drive without headlights ON?
Is it proper to hit someone from the back?
You could have been running for your life, for all you knew - I mean, no visible signs, a car with no lights on charges at you in a middle of the night, you did nothing wrong... they should REALLY pay for this one.
I would raise a storm over this one to be honest. (Unless of course, you really were guilty party which I doubt)

So, if their insured was driving the vehicle at the time, then who in the hell else caused the accident?!? ....it certainly wasn't you. Taking a leak (on private property or not) doesn't usually cause a driver to deliberately ram another vehicle. The issue should be who caused the collision, not the whereabouts in which it happened.

That is the typical insurance bull**** letter they send to avoid a payout... so they can keep their profits in the realm of obscene. I would not pay a #$%^ing dime out of pocket.

Do not let the fact that you were doing something like pissing on private property effect anything... that is a separate matter and has ZERO bearing or impact on your case.

Security guy was at fault, and they should pay.
