LOL, sounds like something I would do. jk. & its amazing, its been a week since the accident and I haven't felt any pain anywhere except my lower back that hurts a tiny bit, gonna get it checked by my chiropractor though.

I agree its not much damage from a true 45mph impact. I've seen tons of vehicles with a lot more damage in the 25-30mph range.
You also got to consider that the vehicle that hit you was probably braking hard which causes the nose to dip down low... which casues less visible damage. If it was a straight on implact with no braking (like in the video) the damage would have been a lot worse.
I still don't understand why you would be a fault at all. You can't really be expected to see a vehicle at night without it's headlights on. Who was stating 50/50? Your insurance company? The cops? I would fight that!

Thats what the other driver said, LOL! I mean why lie about going faster right? He also failed to brake so he probably wasn't going that fast. I called the police and they came but they said they don't take police reports inside a residential neighborhood. Insurance says right now its 50/50 but as soon as someone gets the 51% its over.

I was in a similar type of accident in my 350z. I was t-boned making a left - I'll spare the details, but the fact of the matter is, I have State Farm as well. They would not fight the case and called it a 50/50, though I was making a left on a green arrow. This might sound funny to some of you... but I will share.
I called Larry H. Parker. I have not paid a thing. The accident was in April 2011 and I just signed paperwork 2 weeks ago. I am now receiving $5800 in damages - cash in my pocket next month. Call a lawyer. Call Larry.

I am not trying to start a "S" storm here but I have seen hundreds of side impacts in my 10+ years as an accident investigator. Judging by the damage on the OP's vehicle I would say that the impacting vehicle was moving no faster than 20 mph. Here is the link to the testing at only 31 mph http://www.youtube.com/watch?v=J5g3VMTFugM Note the heavy roof damage to the vehicle, at 40+ mph this vehicle would be caved in to the center consul area. Our general rule of thumb was that any vehicle side impacted in the doors at 45 mph or greater had less than a 5% survival rate. Op I am glad you are OK. Next time look before you leap my friend.
Second is my own experience:
I was t boned by a Camry (women who did not see the red light) she claimed that her speed 40 mph. I swerved so i did not get hit at the doors so she hit me directly on the front wheel assembly. My car had 25K+ damages and All State decided to total it. Subaru shop mentioned that they needed to rebuild the engine as it was pretty banged up from the impact and there were many things broken. The front axle was gone and pretty much the frame was also bent after the car spun and she hit me again at the side (rear).
Lucky I had little whiplash as all the impact was absorbed. the women had to deal with 2 totaled cars.
Again i had to fight with the insurance agency to get the correct result. I was never going to drive a bent rim fixed car.
From that time I wait 2 seconds for the red light jumpers to pass.

I do not think you are at fault.
If he had no lights on how can you yield to a vehicle you cannot see?? A car at night with no lights on is very dangerous and you virtually cannot see it.
