Your rates shouldnt go up being that the other person at fault. Most of the time the victim(you) are suppose to let the insurance company handle everything on both ends.
Correct me if im wrong. I dont have any experience in insurance claiming

I think you're suppose to call your own insurance company first?

To most insurance companies, a claim is a claim and when they see that you have made so many claims they jack up the rates. This being a hit with evidence and prolly a police report, I would stick it to the other company and the guy if I could.
Its the person at FAULT's insurance company to handle the problem, thats why the police issue ticket(s) to the person who caused the accident, intentional or not... even if its not your fault technically. I've been through it a few times.
