Don't disagree but can't fault floyd56's if it is someone from the dealer. I too wouldn't want someone disparaging my reputation based on her incomplete story.

carolesays has no ground to claim she was wronged. Is she disappointed, yes and she has a right to be as she wanted that GX. Why wouldn't/couldn't she take the time to sign a sales agreement and wire or overnight a deposit. By not doing so, as far as I'm concerned, there was no sale - regardless of her 'intent'. Period.

You seem to disagree but honestly if anyone of us owned the dealer (and with sales as bad as they are these days) we wouldn't treat it any different. The exception would be either a long time customer who has purchased a number of cars previously or a personal friend. She was neither and as such I'd insist on at least a firm deposit if not also a signed sales agreement in hand before taking car out of sell-able inventory (even if deposit was only $100 cash).

CC payments, unless the card is physically swiped, put whoever punched it in liable (no recourse w/ bank unless it's physically swiped). As such, there's a reason the dealer didn't want to use it as a deposit - too much to risk. Suppose she never came back and they missed the real sale? They'd be out both her deposit and the sale. Not something I'm willing to risk - especially these days.

Was it that hard to get a sign a sales agreement showing the vin#? I highly doubt the salesman or sales mgr didn't request it. Anytime I've purchased a car via phone/fax, even just a quote, once the vehicle is narrowed down to a specific one I immediately get emailed or faxed a sales agreement. My gut tells me it was offered and she declined. Either by claiming no fax or not near a PC to get email which essentially means she refused to sign making the deal solid. I'm not in car sales but bottom line, like everything else, it ain't an agreement until the parties sign the paper.

Alright, already...As I wrote; not angry or pointing.
It was 4 Ya'Alls Info.
I didn't screw up, I didn't know any better.
Now thanks!! I do. I WAS trusting his word of our agreement. He said credit card info good enough
GX was going to be picked up Tues when he returned from his days off.
Now if you want a project, because of the GX deal I sold my car... the next ... I gave the guy in Denver my word on Friday after the GXdeal.
Now I am "desperately seeking THE GX"
PS: I am very particular, my cars become family and very well kept.
Being a solo girl driver I know a certified one is the best for me.

Sounds to me as if Carole's "mistake" was to trust someone that apparently made her a promise.

I don't know of anyone who would insist on paying a higher deposit or signing a more restrictive agreement than they have to. Carole obviously felt this was an ironclad deal.

Were there suggestions to do a real contract, with provisos of that the deal was not really final until this happened? What might have been said or maybe not really heard? Who knows? Possibly the original parties could not be sure at this point.

The sales guy lost out on this also. Did he offer to help out at all, perhaps in doing a search for a very similar used vehicle at the same deal?

I was "insisting" on CC depsoit and he was taking my info; address, insurance
Was going to overnight me the papers
I say they got a better offer,the way he blew me off the next day.
and told me "this happens all the time"...
He knew I have been wanting a GX since '05.
I was surprised he made no offer to find me another, I am ready 2 buy

No, I mean was the color rare or something?

Because the only thing in that list that is somewhat hard to find is the 2007 part. I am mostly seeing 2005's and 2006's.

So unless you are looking for an out there color combo, it shouldn't be that hard to locate.

What's so hard to understand? She wrote what features she wants, which clearly states 07 model. If anybody can help her find one, then that's good. Why insist on 05 and 06.

Let me be "more clear"
The GX I almost bought was:

2007; better Nav. system
Ash Blue; not a popular color I am finding.
I like this color because it is closest to
black w/o as much maintenance.
Gray Interior; with Sport Pkg, you get the gray/dk wood.
Spoiler; like the look
Lexus chrome wheels; sharp look
CPO; a must and LOW miles.
Sounds like sporty luxury!
Saw a 2009 last night in Titanium with chrome wheels, spoiler
and the walnut wood with gray interior it was a beauty.
Trying to pay cash is another reason for 2007.
I appreciate all the feedback as I am just getting started

If you can pay Cash for an 07--why not get you a NEW one if someone has one and use that money for down payment and finance the small amount left--that way you get what you want faster and its NEW--your baby from the start

The car has several options, I was just looking for clarification. And I am not "insisting" on anything, I'm not even buying the car. I just was observing that the majority at the moment will be 05 or 06, because 3 and 4 year leases coming due.

Correct on the nav, it's way better, but you can find it on some later model 06's.

Dark blue is tough, I don't see a lot of those, and the Sport packae makes it infinitely harder, at least around here. If the wood is all you are after, you might think about doing a quality wood kit and therefore opening up some options. Those usually run around $800 for all the wood installed.

Spoiler ought to be pretty standard.

I wouldn't worry about the chrome wheels, if you find the perfect one without, they can always be put on.


Are you going to keep it for a while? If it's only for 3 or 4 years, you might think about a new one on a one-pay lease and save some cash. Just a thought.

I am not sure I agree with that statment. If i finally found a car I been searching for and it has all the right options and I already sold my old car, I think I would lock it in with a contract to make sure the car is reserved.

I didn't do a verbatim of my GX deal,quick fill-in:
I saw the GX online @LOS,called salesman he didn't know any details,would
get all my questions answered & return call.
I listed my "desirable car" thinking maybe it would sell in time-
I got a full cash offer call,told the guy,let you know as soon as I found out
my info. Now Fri AM made LOS an offer,accepted,the papers were to start, called guy
in Colo,he was coming for car...and so on.
Thats All, I messed up trusting all was as said, you have all pointed out what I shoulda done.
Lord help the next car salesman!
