Default Got T-Boned - Now what?

Fate finally caught up to me when another car T-boned me (low speed). Damage was mostly to the drive side doors etc and I can still drive the car albeit I have the ugly plastic bag covering the driver window opening.

Police report said the other dude was at fault and I went to the hospital as a precaution. His insurance is going to pay. Question: Is there anything I should/shouldn't do in regards to maximizing my compensation from his insurance company? Will the car be totaled? Any past experience in appreciated.

what is his coverage?

do you have under insurance?

are you hurt?

will you miss time from work?

What you shouldn't do is pump up the situation for a higher payout. Not saying you will but don't. You may receive the high payout and think everything is all good... not knowing that the claims dept. will continue to investigate after the fact. I know of several cases that this has happend being in the insurance industry.

If you got hurt then you are justified but the last thing you want to do is claim whiplash and then go snowboarding next month. Just be truthful and firm in what you are seeking. Let your insurance adjuster do the work... doesn't sound like you need to seek an attorney. if you do, you cut your insurance company out of the picture from helping you and you'll give up half the payout to the attorney for their fees.

This is when you'll find out if you picked the right insurance company. They should be going up to bat for you.

I have a biased opinion on the companies just from being in the industry for 14 years. And what I should have said the agent and/or claims adjuster should be going up to bat for the client. Some companies, agents, adjusters don't even try to put up a fight.

As Parker mentioned it's prob going to be a total loss. OP have you had any updated from your adjuster?

Took it to get an estimate from the repair shop. According to them the repair is 50% of the car's value so they suspect the guy's insurance company will repair the car. Hoping so.

with accident settlement you should also get, request, additional funds for the diminished
value of you post accident GS. For instance I would expect a following Carfax on your GS to reflect
the accident and repairs and as such a lower value for your car. I have been away from the claims
biz for a few years so not sure what diminished values or % currently is. A google search should provide some good info on such settlements. Good luck with your GS.
