Unhappy Car Got Into A Pile Up, Insurance Repair Man Screwed Me Over, What Can I Do?

My 2nd Gen 99 GS3 is registered in Florida, but i live in NYC. I had my uncle register my car so everything is in his name, this was done because im cheap, 500 every 6 months is better than 1600!

While on an extended vacation in Florida i agreed to let him use my car while his was in the shop.

Some stupid taxi driver took out 6 cars on the highway, my car was the 2nd to last one hit the pile up. My front bumper was completely pushed in, cracked with no frame damage the repair man told my uncle. I may post pics later because it may help with what im going to ask.

All in all, hood was slightly crumpled, bumper cracked in, rear bumper cracked. He replaced them, my uncle called me and said the car is done but the repair man wanted to change out the headlamps because "The clips are cracked..." Now the old headlamps in my car did not appear damaged my uncle said, and they looked very much intact in the housing in the pics he sent me...
He let him replaced the head lamps because of "cracked clips."

I finally get back to NYC 2 weeks after the repair, car looked fine brand new even. I pull the car out after 1 week of rain off and on. Drivers side head lamps FILLED WITH MAD WATER. Looks like i could put a gold fish in it. Today condensation all over.

The rubber parts around the headlamps are peeling off, it looks retarded the seal does not look proper. Before heading to work i took the car to my mechanic who works on nothing but GS300 and other lexus cars. Right away he said "NO good, those are aftermarket, and they are gonna have to be changed."

Ive never been in an accident or had to deal with insurance claims, shouldn't the mechanic have put the OEM headlamps in? My uncle claims he didn't notice the ***** job and jacked up weather stripping around it.

What can i do? My insurance is being canceled in 4 weeks, can i hold the mechanic responsible force him to put OEM back in and remove the aftermarket units..
Also was my uncle lied too, did they remove my 100% perfect OEM units and give me cheap busted ones, do you guys buy the clip being broken story?

Damn that sucks. Some insurance companies actually don't replace everything with oem parts. Its possible that they did stay within their guidlines. However, you do have a valid concern on the origibal ones still being good. If your insurance company does cover oem you can have the claim adjuster reopen the claim due to faulty repairs.

Is your insurance being cancelled because you aren't the registered owner? I've had clients add vehicles that they just bought but forget to change the registration within the required time. When they have a claim we will non-renew the account. It would be covered but since they din't have " insurable interest" by not being the registered owner then they can't insure it. Technically insurance companies can walk away from these claims all together based on that alone... But some do pay out on good faith.

I'd reach out to the adjuster first to see if they repair using oem parts or after market.

I hate Outta state plates on People who cant afford insurance.. I Religiously stay away from BK/Queens.. Nothing but FL/PA plates.. If you get into an accident guess what..The other driver gets ZERO!..Which leads to Local Court.... Not to mention its illegal and another reason why NY state insurance is so high.

Been there done that... Nothing a Nice Baseball Bat cant fix..Youll be surprised how quickly people find money.

Repair shops are not REQUIRED to put back OEM, Unless that's what you agreed to and Itemized in the repair receipt quote.

Thing is we have had insurance for over 7 years now while in NYC.

A cab ran into 6 cars which included mine in the pile up.

My insurance was never forced to come out and pay for anything, the taxi drivers insurance had to repair all 6 cars he ruined recklessly.

The car isnt in my name i just paid for it and drive it. For some reason after 1 accident they chose to cancel it. I was not driving at the time, the "owner" my uncle was.

The taxi dude insurance paid out because he was at fault, my uncle and I are heading to the mechanic this week. Im demanding OEM. The guys insurance should replace what he ruined its not exactly fair to me.

The repair shop is NOT required to put in OEM parts, unless thats what you agreed to and have it on paper..

(I.E) Shop A charges you $1500 for repairs Non OEM
Shop B charges you $3000 for repairs OEM

Parts must be DOT legal and approved, but not OEM required.

discovered a car of mine broken into recently. i have progressive insurance.
had the car towed to one of their preferred shops to get a quote. im going to do the repairs myself though (its all cosmetic.)

side note: i recently read/learned that progressive doesnt have to use oem parts.

i had them email me the estimate
here is some verbage

It's going to be hard to demand anything because your uncle already signed off on the papers saying be agreed to everything. Your uncle should've been a little more proactive. You are basically screwed because you are dealing with someone else insurance. If he demanded that Oem parts be placed on the car, it wouldve been on there. Someone broke into my car at a hotel I was staying in and I made the hotel pay for it....all OEM parts and had it repaired at a Toyota shop. You have to be proactive at the beginning....now it's too late. Good luck.
