Apple vs Samsung
In one of the largest patent laws of its kind, Apple Inc has sued Samsung for $2.525 billion over their alleged infringement of the iphone and ipad with Samsung’s Android technology smart phones. As Apple claims, Samsung owes “substantial monetary damages” for when they illegally “chose to compete by copying Apple.” Samsung claims that it in fact originated some of the technology in question, and has countersued Apple.
If Apple wins, not only will Samsung have to take its phones off the market until they can design them around the patent laws, but Android itself, which is used by many phone companies, will be stifled. Apple seeks to instate a permanent injunction to stop future violations.
Why $2.525 billion dollars? Samsung has overtaken Apple as the larger maker of Smartphones. Apple claims Samsung has cost apple $500 million, while making billions themselves.
Samsung vs Apple
Samsung has had its own courtroom successes, including a ruling in August that Apple had infringed two of its wireless communication patents in South Korea. It resulted in an order for the iPhone maker to pay 40m won ($35,000; Ł22,000) in damages.
The US lawsuit involving the iPhone 5 dates back to April when a complaint about other devices was filed in the Northern District of California. The case is due to go to trial in March 2014.
It involves two so-called Frand patents - technologies Samsung has an obligation to licence on "fair, reasonable and non-discriminatory" terms because they are recognised as being essential to data transmission standards. In other words, if Apple agrees to pay what is deemed to be a fair rate then Samsung will be obliged to let it use the technologies.
I see this just like imports vs domestic when Domestics were the top dogs and now imports are taking over......same goes for Samsung (import) taking over Apple (domestics)....
I for one hate ALL Apple products!
