I have been reading all of the posts in this thread and started paying attention to what mode my AC starts in. Today and yesterday, the temperature was/is under 50 degrees, and every time I have started the car, the AC begins in the fresh air mode. FWIW.

I sent all my information to be reviewed as to its applicability to the Lemon Law.
I was told by an attorney that the Lemon Law cannot be applied to this issue. Reference attorney McGhee at 858-485-9332. That office suggested a Class Action Law Suit but would not provide names of attorneys who could take this on.

That is consistent with what I said in my previous post. If the outside temperature is in the mid 70s or higher, the climate control system will start and stay in recirculate mode every time you start the vehicle. If the temperature is below the mid 70s, it will start and stay in fresh air mode every time you start the vehicle. Again, this is different from the way it was done on vehicles until the last couple of years. They, in most temperature conditions, used to start in fresh air mode, and they would stay in fresh air mode unless the user manually switched to recirculate. And I'm confident that this design change in the last few years is the source of the air quality issues that many feel are plaguing their vehicles.

While it would be ideal if Lexus would do a software change that set the default in warmer temperatures to fresh air mode, the alternative "fix" is for the user just to get into the habit of switching to fresh air mode whenever he/she starts the vehicle and the temperature is in the mid 70s or warmer. While it is a bit an imposition to have to do so, it quickly becomes a habit. Doing so isn't a big deal, and it is certainly a preferable alternative to living with stale air and complaining about it.
