Key FOB / Smart Key Acting weird PLEASE HELP

Hi All - I have a 2007 ES350. Key FOB has started to act funny. Locking and opening the car seem to be delayed and it takes multiple tries of pushing the right buttons on the remote. The battery was just 8 months old but I changed it a few days ago. Problem went away temporarily but is back again. I doubt the battery drained in just a few days. The car dash doesn't show a warning for low battery. Not sure whats happening. Please advice.
