Lexus has offerred me a buy-back
For those of you who are interested, I've posted a couple of times on other threads and it looks like I'm getting closure. My May '07 ES has had the transmission slip (3rd - 4th gear, up to 1500 RPM) on the first and replacement transmissions. I shot video of numerous occurrences (it happens EVERY time I drive from a cold start) and had begin Lemon Law proceedings. Kept Lexus informed on every step.
They offerred to buy back for purchase price minus mileage deduction (standard formula of Purchase Price x Mileage/120K miles).
Just waiting for a date.
It will be some time before I buy another Lexus or Toyota.

excellent. This seems to be the only route, if lexus isn't doing their voluntary buyback program anymore.
advice to anyone in california---
bring your car in EARLY, as soon as you notice something wrong, especially if you drive a lot. If you can't schedule something soon with the nearest lexus dealership, try the next nearest.
You need to get the first defect incident documented as soon as possible, so you don't get burned on the mileage deduction when using the Lemon law.
The video camera seems to be the most powerful weapon. get yourself a $300 camcorder if you haven't already.
It seems that Lexus usually settles when you have a good case with good documentation that could be used in court.

In my state you are also entitled to the difference between trade allowance and it's retail value at time you traded it in on ES350. If that applies in your state it will help you negotiate that mileage charge away.

Great news, Swobro! Of course, even with miles deduction its better than nothing, but still its unfair because you really didn't *enjoy* those miles and by no mean that was a free'n'happy ride. I assume I didn't have to deal with miles deductions because I only had my ES350 for a couple of month before it started flaring 2k RPM. After 4 month of total ownership I probably put 1/3 of my miles on loaners
BTW, I have a feeling if you decide to move into another Lexus (IS/GS/LS/RX etc.), that can give you some leverage to dismiss miles deduction.
