This was a contract sent to me by one of the local "organizers" for a "fashion" show. I'd advise all photographers to stay away from this type of contract. You get ZERO compensation, you LOSE ALL rights (can't post anywhere) and basically the person/company in charge walks away laughing.

I've deleted the names in the contract - she probably already has enough bad press as is and the models don't like her.

BE CAREFUL AND READ THE CONTRACT THOROUGHLY. In this case I kept a copy to spread the word.

Stay sharp on this folks.

Contract as follows...

"
PHOTOGRAPHIC WORK-FOR-HIRE AGREEMENT

AGREEMENT made this _______ day of ____________, 2010, by and between the undersigned PHOTOGRAPHER and the undersigned CLIENT.
This Agreement is entered into in the City of ______________________and County of ________________, State of Illinois and is guided by and governed by the laws of that state.
The undersigned parties hereby agree that all rights, copyrights, titles and interest in any photographs taken by photographer, on behalf of Client belong solely and exclusively to the Client free from any claims whatsoever by the Photographer.
DESCRIPTION of work to be performed:
Photograph models and dancers before and during fashion show on Sept. 17th at (deleted) in Schaumburg.
Arrival time is no earlier than 8pm and no later than 10:45pm.
Dress Attire must be all black and professional. Must return ALL photos, original and edited to (deleted)



This agreement provides for the return of all pictures & video, original and edited within five business days, unless otherwise noted in description of work to be performed or upon final payment to the client (deleted). If the Photographer fails to do so, the Photographer will be liable for any legal costs that may occur in order to obtain the original and edited pictures & video and may be subject to further legal actions and damages and injunctive relief in the event of a photography copyright infringement. Photographer may not use the photos and/or video taken for his/her own promotional purposes, and the photos may not be printed and placed into the Photographer’s tangible or online portfolio unless given permission by the Client, (deleted).
The enticement and consideration for this Agreement is the promise by the Client to pay the Photographer the amount of $0.00. This is a one-time compensation for Photographer's services (sometimes known as a work-for-hire) and Photographer understands that this will comprise Photographer's complete and sole payment.

Sort of like this contract; ALL your images are ours and you get ZILCH for it.

i'm sure the $0 is a placeholder for a negotiated amount.

as for signing over rights to photos, many places require that because they don't want the photographer to use the photos for any other purpose.

If I were to sign a contract I would make sure $0.00 placeholder amount is agreed upon or else once I signed it and do the work they can leagally not pay me anything. There would be nothing I can do if I take them to court either since it is a contract amount and if I tried to show the court the "work" I did by showing them the photos in my possession I just violated the contract and they can just void the whole thing.

There was no negotiation possible with this person. You could have been a famous Maxim or Playboy photographer and the person would still toss out the same contract. This was for a lingerie fashion show. Most of the gals have ugly tattoos and looked highly questionable. Only reason why I got a copy was two of the gals that just started working for her are my buds. Go figure - the two new ones are drop dead gorgeous...but when they saw the contract they couldn't believe the wording.

"So that's why there aren't any good photographers there.." said one of the gals.

why would anyone do the work for free AND not be able to use any of the photos?

Because you got to see half naked chicks and don't have to pay for it - that's cheaper then going to a strip club...

Some past contracts felt like those when shooting for the company that I worked for. Since it was their property/product my use of them outside would have been negligible. Once the shoot was over, the film was handled over. They paid well for the shoot though. Beyond the compensation...the images were simply copyright of the firm. Just love the "staff photo" credit.

You should sign it... then show dressed up like a ninja (all black as requested) with your camera bag. Open your bag and pull out a camera phone. That would be classic.
