man..first ticket!! I can't believe this..
hello everyone,,
it sucks to post up a thread with a bad news..
but I was wondering if some of you guys could share your experience
with handling tickets..
I was on my way back from school with my girl in NorCal, Berkeley,
and I got pulled over cuz the officer states that I ran the RED LIGHT..
I was on the right lane and the police car was on the left lane..
we were both driving down the street, obviously I was little behind him
and all of the sudden, police had to stop right before the intersaction because
a car right in front of him had to make a left turn right before the intersaction light..so I passed him by..no problem here..
but when I reached the intersaction, the light turned yellow and by then
it was too late for me to stop, so I speeded up a little bit so that I won't
get stuck right in the middle of nowhere..and the thing was that the police stopped on the yellow light..
and next thing I know, he pulls me over telling me that I ran the red light,
I told the officer that the light was turning yellow when I was in the intersaction, but he told me that it was red light by the time I was completely
out of the intersaction..
anyways,,,,
I got a ticket, and I know they will be mailing a courtesy ticket again..
my question is if anybody knows how I can fight for this ticket..
I believe I can request for
a trial by written declaration..right?
but how does that really work?
or will it be better for me to just wait until the court date
and go there for a trial??

California law states that your car must break the limit line of the intersection before the light turns red. In other words, if any part of your car was over the white line before the light turned red, you're ok. The police officer that pulled you over knows this, and he's hoping you just pay the ticket and go away.
California VC 21453. (a) A driver facing a steady circular red signal alone shall stop at a marked limit line, but if none, before entering the crosswalk on the near side of the intersection or, if none, then before entering the intersection, and shall remain stopped until an indication to proceed is shown, except as provided in subdivision (b).

Good luck on this one. When it comes down to it, won't it just be his word against yours. And we know which side the court will take. You're only bet is if he doesn't show up to court.

I know I don't really have a chance to win against the officer and the court..
but I just don't wanna pay the fine and admit that I'm guilty when I'm not!
I don't know if I should do a trial by letter or just by showing up at the court

I think the only way you can win is either you hire a attorney or you hope he doesn't show up in court. if he shows up in court its over. you can just hopefully ask the judge for a reduced fine. make up some BS saying like this is your first time getting a red light ticket.

worst case, it's not the end of the world. you'll have to pay a painful fine of a couple hundred bucks, but you can go to traffic school and have it not show up on your insurance. Just can't get any more tickets in 18 months.

Sucks you got a ticket.....When I got a speeding ticket I requested an extension and then fought the ticket. The Cop didn't show and I was FREE!! This rarely happens but I think I was lucky. Also if you end up fighting the ticket and you lose you will also lose the option to do traffic school.
