Tesla uses Mobileye for it's driver aid system and has reaffirmed what others are already saying here: you are not supposed to just sit there like a passenger in the driver's seat. Yes the marketing department at Tesla has run wild with labels like "auto-pilot" but what car company hasn't hyped tech these days?

Mobileye, an Israel-based tech company developing some of the technology behind Tesla’s Autopilot, commented on the fatal Model S crash reported yesterday. A spokesperson said that the company’s current Automatic Emergency Braking (AEB) system is only meant for rear-end collision avoidance and since the crash was front (of the Model S) to side (of a truck), the system was not designed to avoid it.
Dan Galves, Mobileye’s Chief Communications Officer, issued the following statement:
“We have read the account of what happened in this case. Today’s collision avoidance technology, or Automatic Emergency Braking (AEB) is defined as rear-end collision avoidance, and is designed specifically for that. This incident involved a laterally crossing vehicle, which current-generation AEB systems are not designed to actuate upon. Mobileye systems will include Lateral Turn Across Path (LTAP) detection capabilities beginning in 2018, and the Euro NCAP safety ratings will include this beginning in 2020.”
It has never been clear exactly what parts of the Autopilot is built by Tesla and Mobileye, other than the Israel-based company’s EyeQ chip, which Tesla confirmed using for the Autopilot. The automaker also builds its own system on top of Mobileye’s technology, according to CEO Ziv Aviram.
Update: Tesla sent us the following statement in response to Mobileye’s statement:
“Tesla’s autopilot system was designed in-house and uses a fusion of dozens of internally- and externally-developed component technologies to determine the proper course of action in a given scenario. Since January 2016, Autopilot activates automatic emergency braking in response to any interruption of the ground plane in the path of the vehicle that cross-checks against a consistent radar signature. In the case of this accident, the high, white side of the box truck, combined with a radar signature that would have looked very similar to an overhead sign, caused automatic braking not to fire.”
Last year, Tesla committed to keep using the firm’s technology in future iterations of its Autopilot programs following allegations that the company was looking to discontinue Mobileye’s system after Tesla CEO Elon Musk offered a multi-million dollar bonus to George Hotz if he could build a better self-driving platform.
Then earlier this year, Musk was reportedly seen visiting Mobileye’s Israel operations for a “demonstration of several breakthrough developments by Mobileye in [automated driving technology] installed on a trial Tesla Model S vehicle.”

because most humans do so well in that situation.
again, theses systems will get better and better and better... unlike human drivers who seem to be getting worse and worse! will these systems make 'mistakes' as judged by us? sure. but dismissing the tech based on today's limitations would be like judging the potential of flight ONLY on the wright brothers initial efforts.

it would probably do everything it can to stay in the lane at the moment, and then just like the new 2017 E class, will flash hazards and slowly slow down and pull over. Then again, with the general push for run flat tires, this would be a non issue

Classic blowouts today are pretty rare. The only one I ever had (fortunately a rear tire) was back in 1972, just outside Pittsburgh, on the PA Turnpike. I was able to put the spare on (actually an old snow tire) and limp back to the D.C. area with some tire-whine.
More common is internal tire failure from too much heat and over-stress, such as with the Ford Explorer/Firestone Wilderness series.

Even Toyota's Safety Sense system wouldn't be able to sense a trailer ahead of the car, you'd need Lidar or longer ranged radar for that. As they say in aviation, sometimes the holes in the cheese line up and an accident happens.
The human brain is being pushed to its limits when you're driving at highway speeds. Recognizing objects, assigning potential vectors and taking evasive action all take time, and being distracted adds seconds to that. I don't know if the driver could have braked in time if he wasn't watching a movie but an adequately equipped and programmed computer system could have reacted much faster.

I hope that the NHTSA kills the Telsa Autopilot and does not allow for the release of safety-critical automotive systems until they are truly ready for day-to-day use; Autopilot is not ready for day-to-day use.
It has become obvious that Tesla is trying to operate as a Silicon Valley company that tries to beat competitors to the market by releasing software to users even if the software is not quite ready for use. Automakers working on autonomous driving systems of their own, such as GM, Volvo, MB, BMW, Toyota, Google, etc. are testing, refining and re-testing their auto-drive systems and will not release until they are absolutely sure they are ready.
The problem was that Autopilot was marketed as an autonomous, hands-off automatic-driving system, and it does not matter if it was not intentionally marketed as such; drivers were led to believe that it is an automatic driving system. Putting a legal disclaimer on the central screen when the driver activates Autopilot -- that warns that the Autopilot system is still in Beta mode (which essentially is a user-test stage when the drivers are unknowingly recruited as Tesla test drivers) and drivers must keep their hands on the wheel -- is too little and too late. We here all know that such warnings posted to the central display are NEVER read (and thus never understood) before the driver selects the "OK / Proceed" button.
This may work with non-critical systems, such as Apple CarPlay or Android Auto, but it is unsafe to allow safety-critical systems (that could seriously injure or kill the car's occupants if they fail) into the car until it has been certified as safe to do so. Anything less is irresponsible.
