So people should drive without fogs and without highbeams for the same reason?

Come on. Get serious. In many places, that would be considered a frivolous suit, and one could be fined simply for wasting the court's time.

For a tough judge, ignorance of the law will not be a credible excuse. Instead, I suggest use the qualitative term on "except during periods of inclement weather or fog" to your benefit. Suggest saying something in the lines of dusk, fog, reduced visibility settling in, and given the Daylight Savings Time etc. whatnot, you felt it was prudent to be made more visible to oncoming traffic. Specifically when you felt it was less than perfect weather and time of the day.

Unbelievable reason to give for an actual ticket. I would have been fuming.

And if it wasn't such a waste of time, I'd go to court and fight it.

I have to say, here in Maryland, cops are fairly lax. We have all kinds of uber-bright lights on, crazy loud exhausts and I see people driving around with neon lights on sometimes, and no one gets a ticket. I've stopped complaining about Maryland's laws (or their enforcement of them)....because all things considered, we got it pretty good over here....even when compared to our local Virginia and DC brethren.

Legislators probably regulate various vehicle lighting aspects for the same reason, hence why your claim that everyone should want to drive with more light is an absolutely nonsensical argument.

The way I see it is simply this. If you break the law and get cited for it, IMO there are few reasonable reactions, namely:

1) Start obeying the law;
2) Change the law;
3) Vent on an internet forum to make yourself feel better.

I welcome #3 and hope the OP does feel better, but a side effect is that people will wonder why you would break the law.

That's all well and good, but my statement was specifically in reply to your post which said:

So, my reply was not a commentary on whether the law from the OP was good or bad, nor was it intended to advocate not following the law. Given driving in night conditions on dark roads, I would would want to utilize as much illumination on the road as the law permits, and I can't really understand why a person would want to use less illumination than the law permits.

I regret not being as thorough with my response as to be as clear as possible.

Definitely with all that rain we had in the past few weeks...

OP, where at in Louisiana did you get this? I've never had issues in and around the BR area and mine are on all the time at night. I would say at least 50% of the drivers that have fog lights have them on when their headlights are on, around here at least. Somebody wanted to meet their quota and found an obscure law they could ticket for.

IIRC it's the second ring on the headlight control stalk. (Second from the outside, that is.)
