I've found the Motorweek show to be fairly loose on vehicle specs when reviewing vehicles I know well. Examples I recall:

- Stating in their review and on their graphics that the current gen Cadillac STS is a FWD car.

- A piece on the CTS-V when it was coming out and showing clips of a standard CTS driving by and a view of a Corvette engine bay.

The list is fine, all the models that are on the list are new for 2010. The M3 has been out for a while. Lexus only introduced the hs250h and the rx for 2010 and there isnt a suv on the list and hs250 doesnt do anything well. I dont see what all the drama is about...

Yes, the HS doesn't get the best MPG of any luxury car.

Look the HS is no fan favorite, its not an enthusiasts car but it hits its target market.

It probably does of any luxury car currently in the American market, IF you consider, by the term "luxury car", simply a vehicle with an upmarket/premium nameplate. The HS does indeed carry the Lexus namplate, though it is not anywhere near what I would consider a true luxury car, which would, IMO, be along the lines of the Lexus LS460 or Mercedes S-Class.

So, I think I can see John Davis's reasoning on it, but only on a technicality. I also see your reasoning, on a more practical matter.
