CPO inspection standards are very high, if not the highest in the industry. Those three criteria were not met by any stretch of the imagination, please call Lexus ASAP. Good Luck

PS: i am sorry about the false info but it is the driver side rear bumper near the wheel that is misalign (zoom on the picture in the ad) , if that manner. The hole that i am taking about is not a foreign matter laying there, it is really a hole, see the passenger front seat. As for the white scratches, the sunlight is masking it. I will call Lexus canada tomorrow about the criteria of pre owned, because if all is correct, i will have taken the car.
I really don't want to use this site as a bashing ring, but i had to do something to show the dealership that is not right to promise somebody a great car as they stated in this condition: as stated on the description:
This vehicle is in great condition, and has obviously been kept in top condition by its previous owner. The vehicle’s electrical system is in great shape and the engine is running flawlessly. The transmission is running smoothly and requires no tune up. The interior looks and feels clean and has obviously been kept in good condition by its previous owner. All of our cars are professionally cleaned for sale. Buy with confidence knowing that Heffner Lexus Toyota stands behind all its vehicles with the best service and top industry standards.
Also, i have the email after my deposit that the car is 55.000km instead of 52.xxx km and they haven't change on the ad till now ??? Damn, my heart was so into the car that i can't see all the red flags.
I wish i could love this car as your guys are.

By the cracks in the seat that car has way more then 55,000 kilometers. I just bought a lexus with 43,000 miles and i barely have any cracks.

Well, now with all your help, i have gather all in infos to make a case:
1. I have ALL the emails from the salesman and manager: nowhere in the emails it says that the car is officially sold to me and anything about charge descriptions on the deposit.
2. i have an pdf of the bill of sale that i didn't sign to see the description of the sale.
3. i have the back sheet describing the terms and nothing about the deposit lost. Even that, the bill of sale should not be good since i haven't signed.
4. Misrepresentation of the car on the ad: no sign to say that it is sold to me, the km of the car not corrected (54.800km instead of 52.xxx km) and the description of the condition of the car.
5. As mentionned by Ivanz: preown car certification with failed points on esthetic condition.
6. The manager told me that the 500.00 lost is due to lost of potential buyer (didn't show proof) and the time they held the car because of the deposit, but they didn't mentionned this term with me when i deposit the money.
7. The manager charges me fees of lost time and transport and expenses not taking in account most of my time, $.
My recourse:
a. the owner John Heffner
b. Lexus Canada
c. the ontario consumer services
d. mastercard
I would like to know if there is a limited time to accept the partial refund of the deposit or they can use that against me ?
I would like to thanks again the moderator to let my case heard in the forum to let people knows the way that this dealership is handling business.

They cannot charge you any of those fees. Call your credit card comapny and sent the dealer a certified letter stating your intention of taking them to small claims court. Do not give those crooks a dime.

Keep fighting and don't give up till you have every penny of your deposit back. I wish you a good luck as many will do, but if you don't fight hard that good luck will not come. I learned that from my own life.
Believe or not, that very car was on top part of my shopping list a couple of months ago. I live in Mississauga ON, about an hour drive to that dealership. I never made the trip as I bought from a local private sale.

So i called Lexus Canada again, they were very nice to open a dossier on my case and explained to me my recourse of action directely to the owner, mr. john heffner junior.
I did mentionned the CPO points that failed the standards and being honest, i would have taken the car is all the criteria were met, but like you know, it hasn't.
the dealership has stated that i can have my lost 500.00 back if i buy another car within 3 months, but seriously, i cannot be rushed into buying a car and more likely from them with the service i got. I have lose confidence on that.
No one yet as mentionned to refund me 100% yet even thought i'm willing by honesty to give them 100.00 and put my 900.00 to another purchase. Some would say your too nice, but that the man that i am.
I really have trouble loosing 500.00 for something that i have'nt drove and enjoy, i didn't drove the car after seeing the condition of the interior, come on, people will get inside the car, what would they think of a Lexus
The ad is so misleading about the condition description, it should not be pre-own certified for that price, but i didn't make the rule.
I left a message for mr. john heffner junior and hope he call me back to settle that bad situation.

UPDATE:
After taking all your inputs and advices, the dealership has agreed to refund me THE FULL DEPOSIT AMOUNT  Emotionally, i do like to thanks for all your help.
Lexus Canada probably did a lot also since i've called them with your advice. I will fill their survey for sure.
Taking everything i've learned here, i will hunt for another GS in a near future.

This is by far the most ridiculous story I have heard involving a Lexus dealer.
I am sorry for your loss, I hope you recover it. As suggested by other members, file a lawsuit if necessary.
But before that, since you paid with you card, you can call your credit card company and dispute this matter.
I paid for my motorcycle service with my card once, bike wasn't fixed properly and I called my credit card company after failing settle with with the shop. My credit card company did refund me and never paid the shop.

giving a deposit without even seeing pictures of the vehicle was your first mistake. believing the dealer from afar was the next. the rest was fairly predictable, but i'm glad you got your money back.

Actually, i saw the pictures of the ad before giving the deposit because it seem all good from that resolution. While giving the deposit over the phone, the salesman told me that it is in very good condition in and out, even he mention that the rear bumper need to be repaired due to a claim and everything will be as new. I always think that a deposit is refundable until the official sale
But one thing i really notice is the power of the forum, because i gave Lexus Canada know that i've shared my worries in here and they verified it. And probably the dealership also took a look and it not worthed to waste a 1000.00 over the dealership reputation. That is what is think.
